Court States Sexuality Not An Issue For Judges Deciding LGBT Cases


Not that we should be surprised, but the U.S. District Court for the Northern District of California ruled that gay judges can impartially judge on matters involving LGBT rights. The obvious factoid only became an issue when supporters of Proposition 8 tried stopping Judge Walker's termination of the bill because he's way gay himself. The proponents somehow thought his judgement would be unethical -- don't worry, the irony doesn't escape us, either.

Lambda's staff attorney Peter Renn had this to say about the decision, which was handed down yesterday: "The court decisively rejected an outrageous attack on the integrity of Judge Walker, not to mention judges in general. The motion was a sideshow designed to deflect attention from the fact that the proponents had every chance to prove that Prop 8 was constitutional, but could not do so. Prop 8 was declared unconstitutional because it is unconstitutional -- not because the judge is gay."
